Tommee Tippee x COPE October Donation

These terms and conditions (the “Terms”) apply to the charitable donation promotion described below (the “Promotion”).

1      Promoter and Charity Partner

The Promotion is organised by the Promoter Mayborn ANZ PTY Ltd, trading as Tommee Tippee, ACN: 154 703 134, whose registered office is at Unit 21,15 Ricketts Road, Mount Waverley, Victoria, 3149, Australia (“Mayborn, we, us or our”).

Mayborn has partnered with Centre of Perinatal Excellence (COPE), a registered charity in

Australia endorsed by the Australian Charities and Not-for-profits Commission (83 165 215 449), whose registered office is at Level 2, 696 Bourke St, Melbourne, Australia (the “Charity Partner”). 

Mayborn uses the Charity Partner's name, logo and branding with the Charity Partner's permission. The Promotion does not imply any endorsement by the Charity Partner of Mayborn’s products beyond the donation arrangement described in these Terms. 

The Promotion begins at 12:00am (midnight) Thursday 1 October 2026 and ends at 11:59pm Saturday 31 October 2026 (all times Melbourne local time), unless terminated earlier in accordance with these Terms (the “Promotion Period”). 

2      Eligibility

The Promotion is open to customers who make a qualifying purchase through the website: www.tommeetippee.com.au (the “Website”) during the Promotion Period and who have a delivery address in Australia. 

No additional payment, registration or action is required by the customer to trigger a Donation. The Donation does not increase the price paid by the customer. 

3      Qualifying purchases

A qualifying purchase means a completed and fully paid order placed through the Website during the Promotion Period, provided that the order is not subsequently cancelled, returned or fully refunded within 30 days of purchase (the “Qualifying Purchase”).

The following do not count as Qualifying Purchases:

(a)   orders that are cancelled, returned or refunded (in whole or in part) under the customer's withdrawal rights, the consumer guarantees, or otherwise;

(b)   orders that are not paid in full;

(c)   purchases of gift cards and delivery charges; and

(d)   any order Mayborn reasonably determines to be fraudulent or made in breach of these Terms.  

4      Donation mechanic

For each Qualifying Purchase (that is, each qualifying order, regardless of the number of items it contains), the Promoter will donate A$1 to the Charity Partner.

The Donation is made by Mayborn from its own funds. It is not a separate charge to, or contribution collected from, the customer.

If a Qualifying Purchase is later cancelled, returned or refunded, the Promoter may adjust the corresponding Donation accordingly, provided that the Promoter will not seek recovery of any amount already paid to the Charity Partner.

The Promoter will pay the total Donations to the Charity Partner within 60 days after the end of the Promotion Period, or on such other basis as the Promoter and the Charity Partner agree.

The Promoter guarantees a minimum total Donation of A$3,000 to the Charity Partner.

5      Substantiation and transparency 

Mayborn will keep accurate records of Qualifying Purchases and Donations and will make the total amount donated available on request.

All statements made about the Promotion, including the amount donated per purchase and any minimum donation, are accurate as at the start of the Promotion Period. Mayborn will not make any representation about the Donation that is misleading or deceptive. 

6      Consumer rights

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on a customer by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted or modified by agreement. 

The Promotion does not affect the customer's standard rights to return goods, obtain refunds, or rely on the consumer guarantees in respect of any purchase. 

7      Changes and termination

Mayborn may amend, suspend or end the Promotion where required for legal or operational reasons, provided that any such change will not affect Donations already accrued in respect of Qualifying Purchases made before the changes take effect. If the Promotion ends early, Mayborn will still honour the minimum Donation of A$3,000 to the Charity Partner.

Mayborn will give reasonable notice of any change on the Website.  

8      Privacy 

Any personal information collected in connection with a purchase in handled in accordance with Mayborn’s privacy policy at: https://www.tommeetippee.com/en-au/pages/privacy-policy and the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

9      General 

Subject to clause 6, and except for any liability that cannot lawfully be excluded, restricted or modified (including under the Australian Consumer Law) Mayborn’s liability arising out of or in connection with the Promotion is limited to the maximum extent permitted by law. 

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect. 

These Terms constitute the entire agreement between the customer and Mayborn in relation to the Promotion. 

10   Governing law and jurisdiction

These Terms are governed by and are to be construed in accordance with the laws of Victoria, Australia. 

Any proceeding arising out of or related to these Terms may be brought in the state or federal courts located in Victoria, Australia, and the customer and Mayborn each irrevocably submit to the non-exclusive jurisdiction of those courts with respect to any such proceeding.
